This week in our Law Tips blog I am pleased to share a popular topic for this time of year: ?How The IRS Can Be A Friend In Charitable Gift Planning.?? Sound unlikely?? Advice provided by one of ICLEF?s faculty explains how this is a very reasonable scenario.
Pamela Jones Davidson, J.D., is President of Davidson Gift Design, Bloomington, Indiana, a consulting firm specializing in gift planning, planned giving program design and implementation, and training. She is also a Senior Vice President for Thompson & Associates, offering estate planning services to nonprofits. Ms. Davidson offers her expertise for fellow lawyers advising their nonprofit clients during ICLEF?s seminar on ?Representing Indiana NonProfit Organizations.? Pamela outlines several options for helping clients structure gifts under the IRS rules that are beneficial to charities and donors.?? Following is a summary of her valuable tips on this subject.
Pamela reminds attorneys how the IRS regulations help charities every day in charitable gift planning:? They help us negotiate gifts that a charity really wants, that work to advance the donor?s goals, and help all parties avoid pitfalls. Charitable giving deductions are still intact, though vulnerable.? Currently, it is one, along with home mortgage interest, of the very few protected deductions.? There is no floor to charitable gifts except that one must be an itemizer to deduct the gift, and some ceilings pertain to the type of gifted property (cash vs. noncash) that can be easily planned for six total years to fully write off a charitable deduction.? And, a client can lose if their income level subjects them to the 3% phaseout of itemized deductions.
Charitable estate planning options may be the very best still available. This is true both for charity and in furtherance of the financial and estate planning objectives of many prospective and current donors. The issue is how you use these advantages presented by the IRS. These advantages can be found within pre-tax giving of charitable plans, charitable remainder trusts, gift premium reporting, fair market value, discounts for minority interests, capital gains savings?.even appraisal and substantiation rules and UBIT implications can improve the gift.
In Ms. Davidson?s conclusion, she states that often the choice is charity vs. government. Giving does have cost to the family, but government takes the biggest loss from a variety of lost tax revenues. This is the golden opportunity to give locally to the community, for donor or family to oversee uses of funds, to memorialize and pay tribute to people they care about, to endow their much-needed annual support to a beloved charity, to make a lasting and meaningful difference, all while depriving Uncle Sam ? a passion for some. And all this comes to pass while the donor determines how the gift is ultimately used.
The goal always of charities is education and awareness. They can be option makers. Charitable planning is one of the last, best planning options ? last only because only now are they enjoying popular appeal by nonprofits and practitioners and prospects.? Charities can use IRS rules and regs as leverage with donors.? Require them to document better, be more realistic, face practical and business issues, e.g., if they can?t sell an item of real estate, why would they think charity could, and without liability and expense? The charity creates its own reputation for business, both from its own vantage and from the donor?s, in helping devise a plan to achieve many of the donor?s financial, estate and retirement planning objectives in an ethical and arms-length manner.
Advisers should call on charity (especially the more sophisticated like higher education foundations, hospitals foundations, community foundations) to help communicate, explain?especially if the gift is irrevocable.? More specialized knowledge, like discussing the tax implications of holding retirement plan assets until death without significant draw-downs, is an added benefit; but the donor?s practitioner should be involved, who represents the donor as a charity cannot do. Your role in the relationship ? you can (and often should) check with an expert about the legal technicalities. Donors have come to rely upon charities as often the best source of information about charitable giving techniques. Advisers should too.?? An enabling ?can do? approach will be most effective, even possibly when the rewards to the charity initially seem remote.
This knowledge on our part as planners can, because of the tax code and IRS requirements, lead donors to the natural conclusion that a charitable gift can be attractive and appropriate in their own personal situations. It?s something they can do. The Model Standards of Practice for the Charitable Gift Planner and legal codes of conduct should be followed to guard against potential abuses, providing restraints on us as well as protection for donors.
The IRS is putting more burdens on the charity.? However, remember that the Service, too, is sometimes wrong, and that a rational argument, derived from reasonable interpretations and motivations, can prevail. It is good from the charity?s perspective to educate the donor, to make?gift negotiation business-like. The charity should be thoughtful and deliberative, do its homework and carefully consider any and all gift proposals?actually even refuse some.
In Pamela?s final words to lawyers representing nonprofits, she amicably reminds you: Not all gifts are good gifts, which the IRS has helped charity protect itself against. IRS as Partner? What a Concept!!

PHOENIX (AP) ? Opponents of Arizona's hardline immigration enforcement law launched a new effort Tuesday aimed at thwarting a U.S. Supreme Court ruling that will allow police to enforce so-called "show me your papers" provision.
A coalition of civil rights groups, religious leaders and business organizations filed a new request seeking a court order that would prevent authorities from enforcing a rule that requires police to check the immigration status of people they stop for other reasons.
The groups are asking U.S. District Judge Susan Bolton to block enforcement of the requirement before it takes effect, arguing that Latinos in Arizona would face systematic racial profiling and unreasonably long detentions under the contentious section of the 2010 law.
They also say that immigration patrols in recent years by Maricopa County Sheriff Joe Arpaio, the Arizona lawman known for his rigid stance against illegal immigration, demonstrate that the law's requirement will disproportionately affect Latinos. Though the requirement hasn't taken effect, Arpaio said his officers have inquired about people's immigration status in the past.
In a separate case, the U.S. Justice Department has accused Arpaio's office in a lawsuit of racially profiling Latinos in immigration patrols. The sheriff denies the allegations. That case goes to trial Thursday in federal court.
Although a different challenge to the Arizona law by the Obama administration succeeded in getting three other parts of the law thrown out by the Supreme Court last month, the administration failed to get the "show me your papers" requirement overturned on its argument that federal law trumps state law. The coalition is seeking to shelve the requirement on other grounds.
Arizona's law was passed in 2010 amid voter frustration with the state's role as the busiest illegal entry point into the country. Five states ? Alabama, Georgia, Indiana, South Carolina and Utah ? have adopted variations on Arizona's law.
Legal experts say the groups face an uphill battle in trying to persuade Bolton to bar enforcement of the requirement because the lower courts might want to wait until the requirement ? which won't take effect until at least Friday ? is enforced to consider actual injuries from the law, rather than confront the potential for harm.
Even if opponents don't succeed in getting the requirement put on hold, some backers of the law are questioning the level of cooperation they will get from federal immigration authorities, who will be called to verify people's immigration status and be responsible for picking up illegal immigrants from local officers.
Federal immigration officers have said they will help, but only if doing so conforms to their priorities, including catching repeat violators and identifying and removing those who threaten public safety and national security.
If federal agents decline to pick up illegal immigrants, local officers in some cases will likely have to let them go unless they're suspected of committing a crime that would require them to be brought to jail.

A new research hub that will investigate the efficiency and whole-life impact of a variety of bioenergy techniques and accelerate the deployment of sustainable bioenergy was announced today by David Willetts, Minister of State for Universities and Science.
The new SUPERGEN Bioenergy Hub is funded by a 3.5m grant from the Engineering and Physical Sciences Research Council (EPSRC) as part of the RCUK Energy programme. The Hub spans six research institutions and involves ten industrial partners. It will start work on 1st August 2012 and be directed by Dr Patricia Thornley of the Tyndall Centre for Climate Change Research at The University of Manchester. Initially the hub will address 10 research projects ranging from turning biomass into transport fuels to capturing carbon dioxide from burning biomass feedstocks.

It is not just going to look at what will work practically, in terms of generating power, but also the impact of such technologies. For example, two of the projects will focus on reducing emissions from biomass combustion. One will involve practical measurement work on real boilers, trying to identify cost effective methods of reducing particulates and other atmospheric pollutants at small scale. Additionally, a fundamental scientific study will focus on identifying key markers for emissions from fuel analyses.

Summary of research via SUPERGEN Bioenergy Hub
Two projects will focus on reducing emissions from biomass combustion. One of these will involve practical measurement work on real boilers, trying to identify cost effective methods of reducing particulates and other atmospheric pollutants at small scale. Lead: Newcastle University
Additionally a fundamental scientific study will focus on identifying key markers for emissions from fuel analyses. Lead: University of Leeds
There is significant interest in substituting natural gas in the national network with bio-derived gas. This is already being trialled via anaerobic digestion routes, which can produce a close match to the natural gas composition, but generally uses feedstocks such as slurry. This project will look at alternative routes to producing a natural gas substitute from other feedstocks, including wood and establish if the environmental and economic balances are worth pursuing when the whole life-cycle is taken into account. Lead: University of Bath
Many biomass supply chains are long and complex, with multiple processing stages and the extent to which material is lost (e.g. in drying or storage) is poorly understood. Work will focus on identifying the most significant losses along key supply chains, quantifying their impact and proposing measures to mitigate these. Lead: Rothamsted Research
It is essential to ensure that bioenergy systems actually deliver real greenhouse gas reductions. However, there are many stages in some supply chains where knowledge of potential greenhouse gas impacts is limited making it difficult in some cases to be confident that substantial reductions are being achieved. This project will investigate key sources of uncertainty and their potential greenhouse gas significance, allowing producers and users to focus on improving these to maximize greenhouse gas savings. Lead: The University of Manchester
Turning biomass into a gas can increase the efficiency and improve the environmental impact of electricity and heat production as well as providing routes to transport fuel and chemical production. Work on whole systems engineering integration of gasifiers will be carried out in close collaboration with industry to develop feasible and robust processing schemes. Lead: Newcastle University
There is increasing interest in heating or torrefying biomass to improve its physical characteristics during handling. Work will be carried out to assess the economic and environmental benefits of this to support decision-making in supply chains. Lead: University of Bath
If the carbon dioxide emissions produced when burning biomass can be captured and stored it could be possible to deliver energy systems with not just low, but actually negative greenhouse gas emissions i.e. where carbon dioxide is removed from the atmosphere while producing energy. Performance validation of key steps in these schemes will be carried out in conjunction with the CCS UK Centre hub. Lead: University of Leeds
Turning biomass into transport fuels is a significant research challenge as substantial processing and upgrading are required to meet biofuel specifications. One way of stepping towards that objective is to produce bio-oil by fast pyrolysis and upgrade that only to the minimum extent required to allow it to be mixed with mineral oil in a conventional refinery. New approaches to this will be evaluated experimentally to establish the feasibility and potential greenhouse gas reductions. Lead: Aston University
There are many different pathways from woody biomass to biofuels, some of which are only just emerging and it makes sense to focus research effort on the more efficient and lowest cost processes as well as those most likely to deliver significant and cost effective greenhouse gas reductions. Whole systems analysis of novel biofuel technologies will be carried out to screen for the most promising technology options. Lead: Aston University

Engineering and Physical Sciences Research Council
A new research hub that will investigate the efficiency and whole-life impact of a variety of bioenergy techniques and accelerate the deployment of sustainable bioenergy was announced today by David Willetts, Minister of State for Universities and Science.
The new SUPERGEN Bioenergy Hub is funded by a 3.5m grant from the Engineering and Physical Sciences Research Council (EPSRC) as part of the RCUK Energy programme. The Hub spans six research institutions and involves ten industrial partners. It will start work on 1st August 2012 and be directed by Dr Patricia Thornley of the Tyndall Centre for Climate Change Research at The University of Manchester. Initially the hub will address 10 research projects ranging from turning biomass into transport fuels to capturing carbon dioxide from burning biomass feedstocks.
